Annie Beaudoin Shares Legal Insight with CBC News about high rates of visa refusal and concerns about IRCC recent decision-making process on certain visa applications.


Retired senior immigration officer Annie Beaudoin has raised concerns that Immigration, Refugees and Citizenship Canada’s (IRCC) growing reliance on technology, AI, Chinook 1.5 & Chinook 3+ and the trends seen by Canadian Immigration Consultant and lawyers which is undermining the fairness and transparency of the integrity of the Canadian Immigration program.


“Refusals should never infringe or breach procedural fairness. And in order to do that, it is required that the officer looks at every single document in the file. Lately, there is evidence that that is not done,” Beaudoin told CBC News.


Now working as an immigration consultant, she says clients are receiving refusals that overlook

documents or ignore key details, reflecting the pressure on officers to process files rapidly. Ms.

Beaudoin stresses that IRCC Officers are under increasing pressure with the current IRCC backlogs and while efficiency is important, efficient processing must never come at the expense of procedural fairness and transparency in Canada’s immigration system.


Ms. Beaudoin’s clients, Chandni Ajwani and her husband Jay Dave, experienced this first-hand. Dave, an Indian national, was initially refused a visitor visa to join his Canadian spouse despite providing credible and extensive documentation and having an active spousal sponsorship permanent application in process. The initial refusal letter failed to acknowledge their permanent residence application in the family class in process with IRCC.


After Annie Beaudoin sought reconsideration, the visa was later approved. The couple was relieved. They are also featured in the news cast and shared their experience with IRCC and with Beaudoin Immigration Consulting. Chandni Ajwani described the first refusal as both unfair and painful: “There was anger, I’m not gonna lie. And the sad part is I know that’s not how Canada functions. Our immigration system is quite fair.”
